FAQ

Workers’ comp, explained plainly

Do I need workers’ comp in California?

California law requires employers to have workers’ compensation insurance, even if they have only one employee. Under Labor Code section 3700 it can come from a licensed insurance company or the State Compensation Insurance Fund, or an employer may be able to self-insure.

What does it pay for?

Medical care and part of lost wages for an employee injured on the job, regardless of who was at fault. If a worker dies from a work injury, it provides compensation to the family.

What are the two parts of the policy?

Part one pays the benefits due to an injured worker under state law. Part two, employer’s liability, protects the employer when an employee can sue for an injury that workers’ compensation law doesn’t cover.

How is workers’ comp priced?

It is classified by the duties your employees perform, using codes from the Workers’ Compensation Insurance Rating Bureau. Each class has a rate, and an experience modification based on your loss history is applied.

Who handles questions about a claim?

Workers’ comp claims are not under the Department of Insurance. The Department of Industrial Relations, Division of Workers’ Compensation, can help with claim questions.
